The following sets out these Terms and condition for use of whiteline website, application and our services.
1.1 These user terms of service and conditions (the “Terms”) are a legal agreement between you and whiteline, Manarat AlMa’arefah Institution (Reg no. 2051224383), whose registered address is whiteline, 2824 10-AlWahah Dist. Unit 2, Dammam 34252 – 8330., are these Terms upon which we, at our discretion, permit you to access and use whiteline mobile application (in each available version, including iOS and android) (each version being referred to hereafter as, the "App") and the pages of our website located at (www. whiteline.com.sa) (the "Website") (the App and Website together, being the " whiteline Service").
1.2 whiteline may amend this Agreement from time to time. Amendments will be effective upon whiteline’s posting of an updated Agreement at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of whiteline Services after such posting constitutes your consent to be bound by this Agreement, as amended. These Terms were last updated on August 2, 2019.
1.3 As a costumer, nothing in these Terms will prevent you or stop you from being able to enforce or receive the full benefit of your legal rights provided under general Saudi law (your “non-excludable statutory rights”).
1.4 By accessing whiteline Service, you are acknowledging that you have read, understand and accept these Terms. These Terms are available in the English & Arabic language.
11.5 whiteline Service is an online platform that list particular activities which may be displayed by us or by third party Organizers/Free Lancers (“Providers”) of the relevant activities for your review. You acknowledge that when you make a booking for a particular activity through whiteline Service, we are an intermediate gate between you and the provider. You further acknowledge that it is the Provider responsibility to run the relevant activity listed in our App.
11.6 You are advised to print and retain a copy of these Terms for your future reference.
2.1 To use the App and make any bookings, you must be 18 years or over. By continuing to use the App and agreeing to these Terms you are representing to us that you are 18 and we can rely on this representation.
2.2 You also promise us that all information and details provided by you to us (including on registration for an account) are true, accurate and up to date in all respects and at all times. You can update or correct your personal details at any time through the account settings section of whiteline Service.
2.3 The App and the Events/Activities offered on the App are only directed at people who access the App and make Bookings in Saudi Arabia (“KSA”). We do not represent that any Events/Activities are suitable outside KSA and you should be careful to satisfy yourself of an Event’s suitability to your circumstances (such as considering your travel arrangements to/from the event because unless this is expressly stated as part of the Event, it is not included as part of the booking). If you choose to use the App or make a booking outside KSA you do so at your own initiative.
2.4 We grant you a limited license to use the App to access and use our services for your own personal and non-commercial use; provided that you comply fully with these Terms (e.g. you must not re-sell your bookings).
2.5 We reserve the right to prevent you using the App or making Bookings, however we will honor Bookings already made, unless you have not complied with these Terms or we are unable to because of circumstances outside our control.
2.6 All rights granted to you under these Terms will terminate immediately in the event that you have not followed your responsibilities as required by you (legally known as a “breach”).
3.1 You acknowledge you will not be able to access and use certain functionalities of the App unless you have internet access or Wi-Fi connected to mobile device. All traffic charges or access charges incurred due to the use of the App are subject to your agreed terms with your mobile network provider.
3.2 We cannot guarantee the continuous, uninterrupted or error-free operability of the App. There may be times when certain features, parts or content of the App, or the entire App, become unavailable (whether on a scheduled or unscheduled basis) or are modified, suspended or withdrawn by us, in our sole discretion, without notice to you. You agree that we will not be liable to you or to any third party for any unavailability, modification, suspension or withdrawal of the App, or any features, parts or content of the App.
3.3 We may change the format and content of the App from time to time. We reserve the right to modify, change, substitute or withdraw any Events/Activities or other information on our App. You agree that your use of the App is on an ‘as is’ and ‘as available’ basis and at your sole risk.
4.1 While you can access whiteline Service without creating an account, in order to book certain activity, you must create an account.
4.2 By creating an account with us, you: Consent to us conducting verification and security procedures in respect of the information provided by you during the registration process Agree to keep your login and account details confidential and secure. Can view your booking orders, view your past bookings, and modify your preferences or profile.
4.3 We reserve the right to decline a new registration or cancel your account at any time (including if you don’t provide us with a valid e-mail address that is personal to you or if you don’t provide us with a correct name and surname).
4.4 To register an account you will need to fill out a form on the mobile App. You warrant that the information you input is true, complete and accurate. You will promptly inform us of any changes to such information (you can do this by updating your account details at any time). The personal information you give us is governed by our Privacy Policy.
4.5 One individual user is allowed to register only one account on the App. You warrant that you will not create fraudulent accounts. You also warrant that you will not use any activities to generate unfair reward credits, coupon cards or extra free sessions in the App to be applied to you.
1.5 We reserve the right to alter whiteline Service at any time, including adding, removing or changing features (which may advantage or disadvantage you). We will give you reasonable notice of any material changes to whiteline Service.
2.5 We may need to change these Terms for legal or business reasons, and we will give you notice by posting such changes on Terms & Conditions page.
3.5 If we change whiteline Service or these Terms to your detriment, you can end your use of whiteline Service at any time. Please see Section 12 for more details on ending your use of whiteline Service.
6.1 Protecting your privacy is very important to us. Please review our Privacy Policy in order to better understand our commitment to maintaining your privacy as well as our use and disclosure of your information. You agree to us using your personal information as described in our Privacy Policy.
6.2 While we take reasonable steps to ensure that whiteline Service is reasonably secure, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any information you post, send or share using whiteline Service may be read or intercepted by others.
6.3 Please note that where we include links in whiteline Service to the applications, websites or services of Providers or other third parties, we are not responsible for the privacy practices of such third parties, or the way they handle any personal information they collect about you. You should ensure you read their privacy policies carefully before using these third party websites or services.
6.4 Apple Inc., Google, Inc., and/or their applicable international subsidiaries and affiliates will be third-party beneficiaries to this contract if you access whiteline services using applications developed for Apple iOS or Android-powered mobile devices, respectively. These third party beneficiaries are not parties to this contract and are not responsible for the provision or support of whiteline services in any manner. Your access to whiteline services using these services or applications is subject to terms set forth in the applicable third party beneficiary’s terms of service.
7.1 In exchange for you complying with these Terms, we grant you, at our discretion, a revocable, non-transferable and non-exclusive license to access and use whiteline Service for your personal use only.
7.2 You acknowledge that your use of whiteline Service grants you no rights in or to whiteline Service or any of our intellectual property rights (including copyright trademarks and patents) other than the right to use whiteline Service in accordance with these Terms.
7.3 Access and use any content, information and related materials that may be made available through whiteline services, in each case solely for your personal, non-commercial use. Any rights not expressly granted herein are reserved by whiteline.
8.1 You may download the App or access the Website free of charge.
8.2 If you decide to book an Activity/Event provided by Providers via whiteline Service, the relevant charge that you will pay to the relevant Provider through whiteline Service will be set out in the relevant Listing. Given that you are entering into the transaction directly with whiteline, you acknowledge that the price for the relevant activity will be as determined by the Providers and as listed in the relevant Listing. We have no authority to amend this price.
8.3 whiteline Service is confirming that any price you pay will be transfer directly to the selected provider after agreed period [agreement between whiteline and the Providers].
8.4 The charges are stated inclusive of Saudi VAT. Further details (including details of our accepted methods of payment) are provided prior to the point of booking.
8.5 Shortly after confirming your booking, you will receive a confirmation email from us, which provides details of the booking you are making, as well as confirming that we are acting only as an intermediary and payment agent for such booking and that such booking is being made from the relevant Providers set out in the confirmation email, subject to these Terms and conditions of that Providers, which are set out in the relevant Listing and which you accepted prior to booking.
8.6 When entering into a transaction with a credit or debit card, you confirm that the credit or debit card that is being used is yours. All credit and debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your card refuses to authorize payment, we will not accept the transaction. We are not obliged to inform you of the reason for the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit or debit card payment in accordance with your requested order. If you dispute any payments taken by us from your payment card, we recommend you first contact us to discuss the relevant transaction.
8.7 Booking order must be used by the date of the Event shown on the booking, or it will no longer be valid (and you will not be entitled to a refund).
8.8 It is your responsibility to check your booking as if you have made a mistake it cannot always be rectified after booking. Please check your booking carefully and contact us immediately prior to the Event if there is a mistake, or if you have not received your booking details.
8.9 It is your responsibility to ascertain whether an Event/Activity has been cancelled or re-scheduled and the date and time of the re-scheduled Event/Activity. We will use reasonable endeavors to notify you of a cancelled or re-scheduled Event but we do not guarantee you will be informed of such cancellation before long the time before the Event.
9.1 This promotion is open to Saudi residents aged 18 years or over and administered by whiteline App.
9.2 Until the deadline date specified in the promotion, whiteline is offering a discount off one eligible booking per new user within the whiteline app.
9.3 The discount is the amount advertised within the whiteline app for the promotion.
9.4 This promotion is eligible for users that sign up to whiteline and create an account with an email address.
9.5 Eligible bookings can be identified by “Deal” alongside Event/Activity listings in whiteline app.
9.6 All eligible bookings must be completed within whiteline app. To receive the discount, you must be a registered user within whiteline app.
9.7 Bookings completed via the app but without a full account are not eligible for the discount.
9.8 This promotion is limited to one booking per person.
9.9 No credit will be applied to bookings below the advertised discount amount. For example, if the advertised discount is 50 SR, booking an activity that costs 30 SR will cost 0 SR. you will not, however, be eligible to apply the remaining 20 SR on a future booking.
9.10 whiteline reserves the right to amend these Terms and conditions of this promotion at any time after coordination with the provider.
9.11 whiteline reserves the right to cancel this promotion at any time after coordination with the provider.
9.12 We accept no liability for damage, loss, injury or disappointment of any kind suffered by this promotion.
9.13 This promotion and these terms and conditions are governed by Saudi Law.
9.14 This promotion is sponsored by the Provider listed on the whiteline app.
10.1 whiteline Coupon card may be booked through our mobile app. when the feature is made available. The value of the coupon will be in SR.
10.2 Once payment has been successfully taken and your booking has been confirmed you will receive an electronic Coupon Card, containing a unique code, via email within 24 hours of booking.
10.3 In order to have a Coupon Card, the receiver must have a valid account and make booking via the App.
10.4 By receiving the unique coupon code in the app, you can use it directly after arranging with the Provider and shall be used only with the specific Provider who issues this Card.
10.5 All Coupon Card, will expire after 3 months from issue.
10.6 Coupon Card cannot be redeemed for cash, refunded or transfer to another account/user.
You agree:
11.1 Not to copy whiteline Service (or any part of it) except where such copying is incidental to your use of whiteline Service in accordance with these Terms.
11.2 Not to make alterations to, or modifications of, the whole or any part of whiteline Service, or permit whiteline Service or any part of any of them to be combined with, or become incorporated in, any other programs.
11.3 Not to disassemble, decompile reverse-engineer or create derivative works based on the whole or any part of whiteline Service.
11.4 Not to remove, modify, alter or use any copyrighted material, brand, trademark or logo owned by us, or otherwise do anything which may be seen to take unfair advantage of our reputation and goodwill or could be considered an infringement of any of the intellectual property rights owned and/or licensed to us, without first obtaining our written permission.
11.5 Not to create alternative servers for use with whiteline Service.
11.6 Not to rely on the accuracy of any data provided to you as part of whiteline Service.
11.7 Not to use or create software which automatically interacts with whiteline Service, such that the level of user interaction required is less than would be required without that software (except to the extent required for web accessibility purposes).
11.8 Not to do anything which may disrupt, damage, or impair whiteline Service (or any part thereof), or prevent other users from using any part of whiteline Service.
11.9 Not to intercept or modify the communications between whiteline Service and our servers.
11.10 Not to deliberately exploit any bugs you find in whiteline Service.
11.11 Not to use whiteline Service for any illegal or unlawful purpose.
11.12 Not to provide or otherwise make available whiteline Service in whole or in part (including any object and source code), in any form to any person without prior written consent from us.
12.1 You can simply choose to stop using whiteline Service. In addition, you may log out from your account via the account settings of whiteline Service. You may also contact us via the "Contact us/Chat" function and request that we deactivate your account. You may also remove the App from your device(s) at any time.
12.2 You acknowledge that your use of whiteline Service is subject to our discretion and we may, in the event of your breach of these Terms, at our sole discretion, withdraw your rights to use whiteline Service on the provision of written notice with immediate effect.
13.1 After making booking for specific Event/Activity from Provider through whiteline Service, any requests for cancellation and refunds should be within the cancellation period set in whiteline Services which is 10 days before the event.
13.2 If the cancellation request within the agreed period, you can use Cancellation button that appear in the App. whiteline service shall confirm the cancellation of your transaction by sending you a cancellation email. The Refund shall happen within 15- 30 working days by the same means of payment which you used in order to make the relevant payment in respect of the transaction that you are cancelling.
13.3 In the event that the Provider cancels (for any reason) any Event/Activity for which you have already booked through whiteline Service, we shall notify you promptly by email and, on behalf of the relevant Provider, shall issue you a full refund within 15- 30 working days by the same means of payment which you used in order to make the relevant payment in respect of the transaction that has been cancelled. Please note that this refund does not affect any legal rights that you may have to seek any additional remedies for additional compensation directly from the relevant Provider.
13.4 If we discover an error in the price of the sessions you have ordered, we will use reasonable endeavors to inform you as soon as possible and allow you to either reconfirm your order at the correct price (crediting or debiting your account as applicable), or cancel your order.
14.1 You acknowledge that whiteline Service enables you to view Listings and enter into transactions and booking with Providers. We also provide a platform for you to communicate with whiteline customer service and post messages, personal information, images, text and other material (“User Content”) which can be seen by whiteline services team.
14.2 You agree that in using whiteline Service, you agree:
14.3 If any User Content makes you feel threatened, or abused, or if you believe any user Content is offensive or otherwise breaches these Terms, please contact us directly.
14.4 By posting or making available any User Content via whiteline Service, or by sending any user Content to us, you are promising us that you have the right and all necessary approvals to use such user content and that we can use it in any media without any payment or obligation to you or anyone else. You further promise us that the availability or publishing of any such User Content as part of whiteline Service will not cause us to infringe the rights of any third party or to be in breach of any applicable law or regulation. You agree to compensate us for any losses we suffer as a direct result of any breach by you of any of the promises made by you in these Terms.
14.5 You acknowledge that we have the right, but not obligation to monitor or moderate any user content. If we become aware of any User Content which we reasonably consider does not comply with these Terms, we may remove it.
14.6 If you post or submit User Content, unless we indicate otherwise, you grant:
14.7 You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such User Content. To the extent permitted by law, you agree to waive your right to be identified as the author of such User Content and your right to object to derogatory treatment of such User Content. You agree to perform all further acts necessary to perfect any of the above rights granted by you to us including the execution of deeds and documents, at our request and cost.
14.8 Whilst we use reasonable efforts to provide a reliable service and software, we do not and cannot guarantee that whiteline Service will be available 100% of the time. All software may contain bugs, and all hardware can suffer failures. You also acknowledge that failures, defects or other issues which have a detrimental effect on whiteline Service may occur due to events beyond our reasonable control.
14.9 You acknowledge that we may transfer our rights under these Terms (and any related claims) to any third party without having to obtain your prior consent.
15.1 The information available through the provision of whiteline Service, including both Listings and User Content (the “Information”) is provided to you for your personal purposes only.
15.2 Please note that while we put in place policies and take reasonable steps to ensure that any Listings are posted by Providers who are reputable, we do not guarantee the accuracy or validity of any Information (including the relevant time, date, cost, location of any activity detailed in any Listing) or in any way endorse the suitability of any activity described in any Listing for a particular age range. You acknowledge that any transaction entered into following review of any Listing on whiteline Service (whether that transaction is entered into via whiteline Service or directly with the relevant third party) is conducted at your own discretion and risk. You are advised to check any Event/Activity timings, age suitability, costing and related event information are valid prior to committing to any bookings or attending an event or place.
15.3 Where whiteline Service includes views, opinions, advice and recommendations, these views, opinions, advice and recommendations are not endorsed by us and, to the maximum extent permitted by law, we shall not be liable on account of the accuracy, defamatory nature, completeness, and timeliness or otherwise of such views, opinions, advice and recommendations.
15.4 Please note that whiteline Service may include links to third party websites. We accept no responsibility for the availability, suitability, reliability or content of such third party websites and we do not necessarily endorse the views expressed within them.
16.1 We accept liability for personal injury caused by our negligence or that of our employees and agents. We also accept liability for fraud and fraudulent misrepresentation by us or our employees or agents.
16.2 If we breach these Terms, we shall only be liable for losses which are reasonably foreseeable consequences of such a breach up to the greater of:

16.4 You have certain rights under the law. Nothing in these Terms is intended to or will affect your statutory rights. Save as expressly set out in this Agreement, all conditions, representations, warranties, undertakings or other terms whether express or implied, statutory or otherwise are excluded from this Agreement to the fullest extent permitted by law.
17.1 If you breach these Terms, then (without limiting any other remedy we may have), we may at our sole discretion, disable, partially disable, modify, or delete any or all of your accounts, block your IP address or device from accessing whiteline Service, or in any other lawful way partially or fully restrict your access to whiteline Service.
17.2 You also agree to compensate us and keep us compensated for any loss we suffer (including financial or reputational loss) howsoever arising, as a result of your breach of any of these Terms.
17.3 If you breach these Terms and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.
18.1 These Terms constitute all terms agreed upon between you and us and supersede any prior agreements in relation to whiteline Service. You represent that you have not accepted these Terms in reliance on any oral or written representations made by us that are not contained in these Terms.
18.2 You acknowledge that your right to access and use whiteline Service is also subject to: applicable law; and any rules or policies applied by the relevant App store from which you access the App (as specified in session 20);
18.3 If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.
18.4 These conditions are governed by and construed in accordance with Saudi law. We both agree to submit to the non-exclusive jurisdiction of the Saudi courts, which means:

20.1 When accessing the App through the iTunes App Store or Mac Store
20.2 When accessing the App through the Google Play Marketplace
You acknowledge that your use of the App is subject to the Google Play terms of service, as set out at https://play.google.com/intl/en/about/play-terms.html (the “Google Play Marketplace Terms”) and in the event of a conflict between these Terms and the Google Play Marketplace Terms, these Terms shall take precedence.
20.3 When accessing the App through any other App store
You acknowledge that your use of the App may be subject to these Terms of service of the relevant App store through which you access the App.
